The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 302/201/34 of the Indian Penal Code.

Allegation against petitioner is that he has killed the younger son of the informant. It is strong suspicion that after killing the informant's younger son the petitioner has thrown the corpse in order to hid it. It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has

Patna High Court CR. MISC. No.55668 of 2022(2) dt.17-01-2023 2/3 falsely been implicated in the present case. It is also submitted that petitioner is languishing in judicial custody since 17.05.2022. It is further submitted that petitioner is neither named in the FIR nor has any witness taken his name during the investigation of this case. Petitioner and deceased are brothers and there was dispute between them over their share in the hereditary property and due to this suspicion the name of petitioner has sprang up in this case. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Tisiauta P.S. Case No. 43 of 2022 on furnishing
