The petitioner has filed this writ petition for quashing the order, dated 28.11.2004, passed by the Superintendent of Police, Bhojpur at Ara, by which the petitioner has been dismissed from service on the charge of remaining authorizedly absent for 180 days.

The learned counsel for the State has submitted that the learned counsel for the petitioner has not exhausted his remedy of statutory appeal and memorial.

On such, the learned counsel for the petitioner seeks permission to withdraw this writ petition with liberty to present appeal before the competent authority within one month from the date of this order.

If the petitioner presents such appeal before the competent authority, the competent authority shall hear the appeal without non-suiting the petitioner on the ground of delay and pass

Patna High Court CWJC No.10053 of 2014 (2) dt.20-11-2017 2/2 order on merits.
