2. The petitioner has preferred this application for grant of regular bail in connection with Sonbarsa Raj P.S. Case No. 80/2025 dated 16.05.2025 registered for the offence punishable u/s 190, 191(2), 191(3), 115(2), 119(1), 308(3), 308(4), 303(2), 324(4), 351(2) and 351(3) of the B.N.S.

As per the prosecution case, informant has alleged that after getting the land registered from the landlord and acquired the Jamabandi & rent receipt issued, on 16.05.2025 at around 3 pm, he was getting the work done of flooring and soil leveling in the warehouse built on that land located at Dehad-
Patna High Court CR. MISC. No.52967 of 2025(2) dt.06-08-2025 2/3 Mod. In the meantime, the co-accused persons along with 200 unknown criminals started demanding extortion and vandalizing the warehouse with the intention of kill the informant. When informant refused, they assaulted on the informant's head with an iron rod, causing head injury and one miscreant fired on the informant which missed. Thereafter, they assaulted him severely causing injury on his stomach, left hand and leg. Thereafter, they snatched gold chain worth Rs. 1,50,000/- lacs and Rs. 15,000/- from his pocket and assaulted him by saying if he will not pay the extortion they will kill him and his family members.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. Learned counsel has submitted that the injury report reveals no visible external injury or significant trauma except vague complaints of pain and swelling which are purely subjective in nature. The petitioner has five antecedents and he is on bail in three other cases whereas he is acquitted in two other cases as stated in para 3 of the bail petition. The petitioner is in custody since 16.05.2025.
5. Learned A.P.P. for the State as well as learned counsel for the informant have vehemently opposed the bail
Patna High Court CR. MISC. No.52967 of 2025(2) dt.06-08-2025 3/3 petition of the petitioner by submitting that the petitioner and the co-accused persons were present at the place of occurrence.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Saharsa in connection with Sonbarsa Raj P.S. Case No. 80/2025, with the condition ;- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
