2. The petitioner has filed the present writ application for quashing the order dated 11.06.2024 passed by the Divisional Commissioner, Purnea in Supply Revision No. 211/2023 by which the Commissioner has dismissed the Revision Application filed by the petitioner.

3. Learned Senior Counsel for the petitioner submits that the P.D.S. licence of the petitioner has been terminated by the Licensing Authority i.e. Sub Divisional Officer, Barsoi, Katihar vide order dated 17.03.2022. The appeal was filed

Patna High Court CWJC No.13060 of 2024 dt.19-11-2025 2/3 against the order of cancellation of the P.D.S. Licence before the District Magistrate, Katihar in Supply Appeal No. 03/2022-23. However, the appeal has been dismissed by the District Magistrate vide order dated 01.03.2023 and thereafter, the Commissioner in Revision has also affirmed the order passed by both the authorities.

Learned counsel for the State submits that the petitioner, without availing the remedy under Rule 32 (vii) of the Bihar Targeted Public Distribution System (Control) Order, 2016 before the Principal Secretary of the Department, has approached this Court. The petitioner may be directed to file a petition before the Principal Secretary of the Department challenging the impugned orders.

Considering the aforesaid submission, this writ application is disposed with liberty to the petitioner to file an appropriate petition before the Principal Secretary of the Department within a period of four weeks from today challenging the impugned order dated 11.06.2024 passed by the Divisional Commissioner, Purnea in Supply Revision No. 211/2023.

6. If an appropriate petition is filed before the Principal Secretary of the Department, the Principal Secretary

Patna High Court CWJC No.13060 of 2024 dt.19-11-2025 3/3 shall be obliged to dispose the same in accordance with law within a period of three months from the date of filing of such petition.

7. With the aforesaid observation and direction, this writ application is disposed.
