JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 06-04-2022 Learned counsel for the petitioner undertakes to remove all the defects as pointed out by office within four weeks after start of normal functioning of the Court. Heard learned counsel for the petitioner and Ajay Kumar Jha, learned A.P.P. for the State.
This is the second attempt of the petitioner to obtain bail in connection with Muffasil P.S. Case No. 11 of 2020 registered for the offences punishable under Section 394 of the Indian Penal Code. He is in custody since 01.02.2020. The petitioner has got seven criminal antecedent as stated in paragraph '3' of the application.
The report received from the court of learned Additional District & Sessions Judge - I - cum - Special Judge,
Patna High Court CR. REV. No.687 of 2021(3) dt.06-04-2022 2/3 N.D.P.S. Act, Begusarai as contained in letter no. 40 dated 21st March, 2022 says that the petitioner has not been produced from the Observation Home, Munger and the disposal of the case is likely to take at least nine months.
Learned counsel for the petitioner submits that the order rejecting the prayer for bail of the petitioner was passed on 07.04.2021. Petitioner has stayed in the remand home for more than two years. It is his submission that till date the case is pending at the stage of evidence.
Learned A.P.P. for the State has though opposed the prayer for bail of the petitioner, but considering that the petitioner has remained in the Juvenile Home for more than two years and at this stage the case is still pending for evidence as also that his father, who has clean antecedent, is ready to stand a surety, this Court directs release of the petitioner above named on bail on furnishing of bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of learned Principal Judge, J.J. Board, Begusarai in connection with J.J.B. Case No. 79 of 2020, arising out of Muffasil P.S. Case No. 11 of 2020, subject to the condition as laid down under Section 437 (3) Cr.P.C. One of the bailors shall be the father of the petitioner
Patna High Court CR. REV. No.687 of 2021(3) dt.06-04-2022 3/3 who will furnish an undertaking that while on bail he would not allow the petitioner to come in contact with any anti-social element or a person of criminal antecedent.
During the period the petitioner remains on bail, the Probation Officer attached to the Juvenile Justice Board, Begusarai shall keep vigil over the conduct of the petitioner and in case any adverse report is made to the Juvenile Justice Board, appropriate action shall be taken thereof.
