JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 379, 386, 504, 506 of the Indian Penal Code and Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act. The prosecution case is that the accused persons were unloading the construction materials on the land of the informant and when protest was made then informant was abused by calling caste name and assaulted with fists and slaps. It is alleged that petitioner snatched mobile of the informant worth Rs. 26,000/- and co-accused Tuntun Singh snatched gold chain. It is further alleged that co-accused Mukesh Singh snatched Rs. 50,000/- from the pocket of the informant.
It is submitted by learned counsel for the petitioner that accusation has been levelled in the background
Patna High Court Cr.Misc. No.2612 of 2016 (2) dt.22-01-2016 2/2 of 144 Cr.P.C proceeding between the parties from before. For the alleged date of occurrence dated 17.04.2015 the F.I.R was registered on the same day but it reached to the Court of learned A.C.J.M on 20.04.2015 which suggests antedating of the First Information Report.
Considering the accusation being levelled in the background of litigated relationship between the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nardiganj P.S. Case No. 32 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
