2. The petitioner apprehends arrest in a case registered under Sections 30(a), 41(1) of Bihar Prohibition and Excise Amendment Act, 2022.

3. As per the prosecution case, there is recovery of 150 litres of country made liquor from the sack tied on the motorcycle and from plastic gallons hidden in the bush near Semuapur Khetwa Nahar.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Further submission is that the recovery is made from open place. Petitioner was neither present at the spot nor he has any

Petitioner is not the owner of the seized motorcycle and nothing has been recovered from the conscious possession of the petitioner. Petitioner has two criminal antecedents, however, the same does not belong to the Excise Act. Petitioner undertakes to cooperate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. 3, East Champaran, Motihari in connection with Dumariyaghat P.S. Case No. 101 of 2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S., 2023.
