The petitioner apprehend his arrest in connection with Kanti P.S. Case No.352 of 2022 registered under Sections 272 and 273 of the Indian Penal Code and Sections 30(a) and 36 of Bihar Prohibition & Excise Act.

Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in the present case. He also submits that the alleged illicit liquor has been recovered from the house of Kunal Kumar and also from the shop of Binod Kumar.

Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the

Patna High Court CR. MISC. No.54493 of 2022(3) dt.02-01-2023 2/2 parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Judge, Excise II, Muzaffarpur in connection with Kanti P.S. Case No.352 of 2022, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
