JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-01-2016 The present application has been filed for modification of order dated 26.08.2015 passed in Cr. Misc. No. 25324 of 2015 for extending the period of surrender. The petitioner being Executing Agent and the Panchayat Mukhiya was alleged to have misappropriated the exchequer to the tune of Rs. 27,09,800/-, but they were granted anticipatory bail by a Co-ordinate Bench of this Court on deposit of the alleged amount of Rs. 27,09,800/-.. It is submitted by the learned counsel for the petitioner that in connection with Kursakanta P.S. Case No. 151 of 2014, the petitioner has deposited Rs. 5,75,000/- and will deposit the rest amount within a period of three weeks. The order dated 26.08.2015 is modified to the extent that the bail bond of the petitioner will be accepted subject to condition that the petitioner will deposit the entire

Patna High Court Cr.Misc. No.1687 of 2016 (2) dt.13-01-2016 amount of Rs. 27,09,800/- including Rs. 5,75,000/- which has already deposited and the rest conditions will be same as stipulated in order dated 26.08.2015.

On the grounds mentioned in the modification application, the period of surrender is extended by three weeks from the date of receipt/production of a copy of this order in connection with Kursakanta P.S. Case No. 151 of 2014 pending in the court of learned Sri A.B.D. Dubey, J.M., Ist Class, Araria. The order dated 26.08.2015 stands modified to the extent indicated above.

Accordingly, this modification application is disposed of.
