2. The petitioner apprehends arrest in connection with Madhepura (Bharrahi O.P.) P.S. Case No. 1026 of 2023 dated 03.10.2023, instituted for the offence punishable under Sections 363, 366A/34 of the Indian Penal Code.
3. The allegation against the petitioner is that he along with other co-accused kidnapped the minor daughter of the informant, when the wife of informant and his daughter had gone at the house of co-accused Shambhu Ram for taking the debt amount taken by him.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.57447 of 2024(2) dt.04-09-2024 2/3 petitioner is innocent and he has been falsely implicated in this case. It is further submitted that date of occurrence is 27.09.2023 but the FIR was lodged on 03.10.2023 i.e. after a delay of six days without any plausible explanation. It is next submitted that there is no allegation with regard to any sexual act by the petitioner in the statement of victim recorded under Section 164 Cr.P.C. It is further submitted that the learned Magistrate has assessed the age of the victim to be about 16 years. It is further stated that petitioner is a labourer and he can never dare to commit such incident. It is further submitted that as per the statement of the victim, petitioner is the friend of elder brother of the victim. Lastly, it has been submitted that petitioner has no criminal antecedents.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner within a period of six weeks from today, in connection with Madhepura (Bharrahi O.P.) P.S. Case No. 1026 of 2023, he/they shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the
