The application seeks modification in the order dated 16.10.2015 passed in Cr. Misc. No. 44198 of 2015 by extending the time/period for surrender to reap the benefit of the order. This Court had extended the privilege of anticipatory bail to the two petitioners with a direction to surrender and furnish bail bonds within four weeks. It is stated that one of them namely Jitendra Kumar Mahto surrendered within time and was granted the bail. The petitioner on account of his illness could not surrender within the time. In this regard, the pleadings made in paragraph 4 have been relied upon.

Considering the facts and circumstances of the case and after hearing both the sides, the application is allowed. The time granted under order dated 16.10.2015 passed in Cr. Misc. No.

Patna High Court Cr.Misc. No.829 of 2016 (2) dt.03-02-2016 2/2 44198 of 2015 is extended to 15th of February, 2016. The order dated 16.10.2015 is clarified/modified to that extent only.
