The petitioner has filed the instant application for anticipatory bail apprehending his arrest in a case registered for the offence under sections 341, 323, 379, 448, 307, 504, 506 and 34 of the Indian Penal Code and section 27 of the Arms Act. It is submitted by learned counsel for the petitioner that during pendency of this application the petitioner has been given the benefit of the provision under section 41 of the Code of Criminal Procedure and as such no apprehension of arrest remains. It is thus, prayed that he may be permitted to withdraw this application.
