JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 10-05-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

The petitioner wants to renew his prayer for bail which was earlier rejected by order dated 4.7.2016 passed in Cr. Misc. No. 17685 of 2016, on the ground that the petitioner is suffering in custody since 21.1.2016, two of co-accused Sunil Patel and Kamaluddin @ Kallu @ Md. Kamaluddin have been allowed bail vide Cr. Misc. No.8564 of 2017 on 1.3.2017 and Cr. Misc. No. 5580 of 2017 on 29.3.2017 respectively and as such the petitioner also deserves sympathetic consideration.

The learned A.P.P. opposes the prayer for bail by submitting that in Cr. Misc. No. 8262 of 2016 one year time was given to conclude the trial, but the petitioner has come just now.

No.19551 of 2017 (2) dt.10-05-2017 2/2 In the facts and circumstances as stated above, finding no good ground for reconsideration of prayer for bail, again prayer for bail of the petitioner stands rejected in connection with Trial No. 243 of 2016, arising out of Majorganj P.S. Case No. 256 of 2015 pending in the court of learned Additional Sessions Judge, Sitamarhi.

However, the learned trial court is again directed to expedite and conclude the trial as per direction given in Cr. Misc. No. 8262 of 2016.
