The petitioner seeks bail in Kangali P.S. Case No. 24 of 2020, registered for the offence punishable under Sections 307, 323 and other allied sections of the Indian Penal Code. As per the prosecution case, petitioner is alleged to have assaulted the informant on his head by means of Farsa causing grievous injury to him.

It is submitted on behalf of petitioner that from bare perusal of FIR it would be apparent that alleged occurrence took place during course of panchayati in which informant along with family members including several villagers were present, as a result of which both sides sustained injury. There is case and counter case. Petitioner claims clean antecedent and he is in

Patna High Court CR. MISC. No.64314 of 2021(2) dt.22-02-2022 2/2 custody since 31.08.2021. Investigation is complete. However counsel for informant vehemently opposed the prayer for bail and submitted that there is specific allegation of assault against this petitioner causing grievous injury to the informant.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Kangali P.S.
