The Petitioner seeks bail in Belsand P.S. Case No. 53 of 2015 instituted for the offence under Section(s) 302, 120B, 34 of the Indian Penal Code and Section 27 of the Arms Act.

It has been submitted on behalf of the petitioner that petitioner is not named in the written report. There is no evidence against him in the case diary. The other co-accused has been granted anticipatory bail by a coordinate Bench of this Court vide Cr. Misc. No. 14670 of 2016 on 02.05.2016. From the written report, it appears that dead body of the husband of the informant was lying near the house of

Patna High Court Cr.Misc. No.8116 of 2017 (2) dt.08-03-2017 2/2 Feku Sah.

Learned 1st Additional Sessions Judge has mentioned that police has submitted charge-sheet against seven accused persons and investigation is pending against this petitioner. From the order of learned Sessions Judge, it appears that no substantive material has come in the case diary against this petitioner.

The petitioner is languishing in custody since 12.07.2016.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Belsand P.S. Case No. 53 of 2015, subject to the conditions that both the bailors shall be the close relative of the petitioner.
