24-02-2022 Heard learned counsel for the parties.
The petitioner seeks bail in Harnaut P.S. Case No. 27 of 2021, registered for the offence punishable under Sections 302, 120(B) of the Indian Penal Code and section 27 of the Arms Act.
As per the FIR, while the husband of the informant was returning from the market, some unknown persons committed his murder. Informant suspects that due to land dispute, co-accused Arvind Singh and his two sons have committed murder of her husband.
Petitioner is not named in the F.I.R. Name of the petitioner has transpired during course of investigation on the disclosure made by Laxmi Narayan Singh (body-guard of coaccused Arvind Singh). Save & except suspicion, there is no
Patna High Court CR. MISC. No.65013 of 2021(2) dt.24-02-2022 2/2 other material against this petitioner to show his complicity in the aforesaid crime. It is further submitted that co-accused Arvind Singh, who was suspected by the informant in the murder of her husband, has already been granted bail by this Court, vide order dated 07.12.2021 passed in Cr.Misc. No. 56480 of 2021. Petitioner is in custody since 22.05.2021. Learned A.P.P. for the State has opposed the bail petition.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Harnaut (Kalyanbigha) P.S.
