The petitioner is in custody in connection with Thakurganj P.S.Case No.94 of 2016 pending in the Court of Shri Md. Firoz Akram, Judicial Magistrate, Ist Class, Kishanganj for an offence registered under Sections 25(1-b)a, 26 and 35 of the Arms Act.
As per prosecution case three persons were apprehended by the police party while they were proceeding on two motorcycles and from the possession of this petitioner a country made loaded pistol was recovered as per seizure list in his presence. The seizure list bears signature of this petitioner. On behalf of the State, it is submitted that the petitioner is named in the FIR.
Patna High Court Cr.Misc. No.5597 of 2017 (2) dt.07-02-2017 Considering the recovery of fire arm from his possession, I am not inclined to release the petitioner on bail, the same is rejected.
However, the court below is directed to expedite the trial and if the trial is not concluded within three months, the petitioner may renew his prayer for bail.
