The petitioner is apprehending arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code and 25(1-B)a/26/35 of the Arms Act. On secret information that the gang of motorcycle lifter assembled, a raid was led when one person was found trying to steal a motorcycle by putting master key in the motorcycle. The apprehended Raushan Kumar disclosed that he along with Munna Kumar, the petitioner, committed theft of a motorcycle but the same was taken away by this petitioner and his friend Ravi Kumar. Patna High Court Cr.Misc. No.1791 of 2016 (2) dt.14-01-2016 2/2 keys and mobile were recovered.

It is submitted by learned counsel for the petitioner that except the confession of co-accused there is nothing on record to suggest the complicity of the petitioner. Moreover, there is no recovery from the petitioner.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Lalganj P.S. Case No.232/2015, pending before the learned CJM, Vaishali at Hajipur.

With the above observation, this application is, accordingly, disposed off.
