2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 323, 448, 504, 506, 354(B)/34 of the Indian Penal Code and Section 8 of the Protection of Children from Sexual Offences Act.
3. As per prosecution case, this petitioner is alleged to have attempted to commit rape with the informant.
4. It is submitted that petitioner is own step-father of the informant and since mother of the informant has solemnized second marriage with this petitioner against the will of her children, this false and concocted case has been lodged against the petitioner. Petitioner has got clean antecedent.
5. Considering the facts and circumstances of the
Patna High Court CR. MISC. No.57124 of 2023(2) dt.31-08-2023 2/2 case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, POCSO, Bhagalpur in connection with Nath Nagar P. S. Case No. 135 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
