The petitioner seeks bail in Vishnupad P.S. Case No. 191/2016, registered for the offences punishable under Sections 420, 274 and 275 of the Indian Penal Code and sections 33EEB, 33EEC and 33E of the Drugs and Cosmetics Act. The petitioner was apprehended by the police and from his possession some drugs to cure Arthritis were recovered. The petitioner is said to have divulged that Sikandar Kumar manufactured the drugs and the petitioner was selling the same in the market.

It is submitted that the petitioner is not the manufacturer of the drugs. Drugs were manufactured by Chanda Ayurvedic Dawakhana which is owned by Sikandar Kumar. Sikandar Kumar

Patna High Court Cr.Misc. No.15785 of 2017 (2) dt.24-04-2017 has already been enlarged on bail.

Considering the facts aforesaid and the fact that the petitioner is in jail since 28.12.2016, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Vishunpad P.S. Case No. 191/2016.
