====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 09-03-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in connection with Muffasil Samastipur P.S.Case No. 251 of 2015 instituted under Sections 379, 427, 504, 506 and 34 of the Indian Penal Code and 3(i)(x) SC/ST Act.

The allegation against the petitioners is that in full public view petitioners humiliated the informant and his son by taking cast name.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. It is further submitted that the petitioners have been made accused in the present case due to mistake of fact. For a petty reason, the alleged

Patna High Court Cr.Misc. No.58549 of 2015 (2) dt.09-03-2016 2/2 occurrence is said to have taken place. It is also submitted that no offence under SC/ST Act is attracted in the present case. On behalf of the State, it is submitted that the petitioners are named in the FIR.

Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Samastipur in connection with Muffasil Samastipur P.S.Case No. 251 of 2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
