JUSTICE ARVIND SRIVASTAVA ORAL ORDER 20-02-2018 Heard learned counsels for the petitioners and the State. Petitioners apprehend arrest in connection with Bettiah Muffasil P.S. Case No. 531 of 2017 registered for the offence punishable under sections 272, 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case. Nothing has been recovered from the conscious possession of these petitioners. Only an empty Gallon is alleged to have been seized from the house of these petitioners. On the allegations levelled, no case is made out under the alleged sections. Petitioners are men of clean antecedent.

No.9461 of 2018(2) dt.20-02-2018 2/2 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Bettiah, West Champaran in connection with Betiah Mufasil P.S. Case No. 531 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
