Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.

The petitioner seeks regular bail in connection with Ganga Bridge P.S. Case No. 173 of 2021, lodged under Sections 414, 467, 468, 471, 420, 120(B) and 34 of the Indian Penal Code read with Sections 30(a), 36 and 41(i) of Bihar Prohibition and Excise Act.

As per the prosecution case, the total recovery of 1710.720 liter of foreign liquor is the subject matter of the present case.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He also

Learned counsel further submits that petitioner is neither owner nor driver of the truck and the only allegation against him is that he used to talk with the truck driver on his phone number. He also submits that antecedent of the petitioner is clean and he is in custody since 01.07.2022 and charge-sheet has already been filed in this case. Learned A.P.P. for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.1cum-Additional District and Sessions Judge, Vaishali at Hajipur in connection with Ganga Bridge P.S. Case No. 173 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
