JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 21-07-2022 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioners as well as the learned APP for the State.

The petitioners apprehend their arrest in connection with Gogari P.S. Case No. 411 of 2020, registered for the offences punishable under Sections 448, 341, 323, 324, 504, 506, 307, 354 A, 379/34 of the Indian Penal Code.

As per allegation, the accused persons including the petitioners entered into the house of the informant and they assaulted her family members. Allegation against petitioner Nos. 1 and 2 is that

Patna High Court CR. MISC. No.65148 of 2021(2) dt.21-07-2022 2/2 they assaulted Kishan Kumar, son of the informant with iron rod. There is no specific allegation to assault anyone against petitioner No. 3.

Learned counsel for the petitioners has submitted that the petitioners are innocent. They are persons of clean antecedents. There is land dispute between the parties and the present case is the counterblast of Gogari P.S. Case No. 410 of 2020 lodged by Poonam Devi, wife of co-accused Ghanshyam Thakur. He has submitted further that though there is allegation against petitioner Nos. 1 and 2 to assault Kishan Kumar but he did not suffer any injuries. Considering the above-mentioned facts and circumstances, especially the clean antecedents, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs.

10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Gogari P.S. Case No. 411 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
