JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 17-04-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner seeks bail in connection with Kasim Bazar P.S. Case No. 145 of 2016 registered for the offences punishable under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegedly, the petitioner fired upon the informant and his nephew when they were going on motorcycle but bullet passed crossing between them. The reason of firing is that the petitioner was pressurizing to marry with the daughter of the informant. Submission is of false implication and that no injury has been caused to anyone, the prosecution story appears not reliable and probable and the petitioner with ulterior motive and only with a view to put pressure has been falsely implicated in this case, resulting, the petitioner is suffering in custody since 31.01.2017

Patna High Court Cr.Misc. No.15426 of 2017 (2) dt.17-04-2017 and as such he deserves sympathetic consideration. Learned APP duly assisted by learned counsel for the informant opposes the prayer of bail by submitting that the petitioner is giving threatening letter to the informant, he has got criminal antecedent and he is a veteran criminal and he wants to marry with the daughter of the informant forcibly and for that he has caused the occurrence.

In the facts and circumstances stated above, considering that no injury was caused to anyone, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Kasim Bazar P.S. Case No. 145 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
