JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-04-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code and Section 3⁄4 of Explosive Substance Act. Earlier the prayer for bail of the petitioner was rejected taking note of allegation levelled against him as well as his antecedent but submission on behalf of the petitioner is that two persons are said to have sustained injury in the present case but both the aforesaid injured, namely, Pradip Yadav and Umesh Yadav have not stated the name of the petitioner in course of trial. Therefore, there is nothing against the petitioner to show that he was involved in the present case.

No doubt, petitioner does have criminal antecedent

Patna High Court Cr.Misc. No.12960 of 2017 (2) dt.26-04-2017 2/2 of several cases but admittedly, the injured, namely, Pradip Yadav and Umesh Yadav have not stated the name of the petitioner as one of the participants of the present case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II, Jamui in connection with Sessions Trial No. 341 of 2013 arising out of Khaira P.S. Case No. 54 of 2013.
