JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-02-2017 This is an application for grant of bail for offences punishable under Sections 20/22 of the N.D.P.S. Act. It has been submitted on behalf of the petitioner that there is alleged recovery of 1 Kg. 700 grams ganja and petitioner is ready to abide by any condition imposed upon him. Heard learned A.P.P. also.
Having heard both sides, in view of the fact that recovery of 1 Kg. 700 gms. ganja was made, which is small quantity, he has no criminal antecedent and is in custody for about two months, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna, in connection with
Patna High Court Cr.Misc. No.4720 of 2017 (2) dt.14-02-2017 2/2 Sultanganj P.S. Case no. 260 of 2016 with the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned. (ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
