The petitioner seeks bail in a case registered for the offences punishable under Sections 413, 414, 34 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act. The learned counsel for the petitioner submits that the petitioner is in custody since 28.11.2020, charge-sheet has been submitted in the case and has antecedent of 12 cases. The learned counsel for the petitioner submits that the informant alleges that he reached the place of occurrence and apprehended three miscreants including the petitioner and during course of search, one country-made pistol, one cell phone and two number plates of motorcycle were recovered from the possession of the petitioner.

No.64501 of 2021(2) dt.01-04-2022 2/2 The learned A.P.P. for the State opposes the bail application and submits that it appears that the petitioner is a habitual offender having antecedent of 12 cases. Considering the fact that the petitioner is in custody and charge-sheet has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Falka (Pothia) P. S. Case No.380 of 2020, subject to condition that one of the bailors shall be the father of the petitioner namely, Gopal Mandal. Further, if the petitioner is implicated in a case of similar nature, the learned Court below shall forthwith cancel his bail bonds. The petitioner shall be released only after framing of charge and if the charges have been framed then the petitioner shall be released forthwith. The application stands allowed.
