JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-11-2019 This application, for grant of anticipatory bail, arises out of Duadnagar P.S. Casae No. 163 of 2019, disclosing offences under Sections 304/34 of the Indian Penal Code. Allegation as per F.I.R. is that while the son of informant was cleaning the sand mixer machine, petitioner said to have switched on the machine, due to which, he got entangled in the machine and died Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and the machine was already in operational condition as such, there is no question of switching on the machine. Learned counsel for the State opposed the prayer for anticipatory bail and submitted that the materials collected during course of investigation also supports the prosecution case.

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner has to surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.
