The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 224, 225, 353, 120B/34 of the Indian Penal Code. The prosecution case is that the co-accused Babloo Kamat kidnapped a girl from Jalandhar, leading to registration of Jalandhar P.S. Case No. 156 of 2014 levelling accusation under Sections 363, 366A of the Indian Penal Code against the son of the petitioner no. 1 namely Babloo Kamat. When the police went to the house of the petitioner, then the son of the informant, who had kidnapped the girl, did not allow to apprehend the girl and subsequently escaped from the scene.
Patna High Court Cr.Misc. No.533 of 2016 (2) dt.08-01-2016 It is submitted by the learned counsel for the petitioners that the thrust of accusation against son of the petitioner Babloo Kamat. Subsequently the mother of girl has retracted from the initial version and filed a petition to that effect before learned court below. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.
Considering the thrust of accusation against Babloo Kamat, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned J.M., Ist Class, Supaul in connection with Bhimpur P.S. Case No. 44 of 2014, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Dinesh Kumar Singh, J) P.K./- U T
