JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-01-2016 This application has been filed on behalf of the petitioners for modification in the order dated 14.10.2015 passed in Criminal Misc. No. 43426 of 2015 by this court with regard to extend the period of surrender of the petitioners in the court below.
Learned counsel for the petitioners submits that by the order dated 14.10.2015 passed in Criminal Misc. No. 43426 of 2015, in the event of their arrest or surrender before the learned court below by the petitioners within a period of six weeks from that day, the petitioners were granted anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, First Class, Aurangabad, namely, Sri Sanjeev Kumar, in connection with Forest Case No. 35 of 2012, subject to the
Patna High Court Cr.Misc. No.575 of 2016 (2) dt.13-01-2016 conditions laid down under Section 438(2) Cr.P.C. but the petitioners could not surrender within a period of six weeks as granted by the said order. In that view of the matter, learned counsel for the petitioners prays for extension of period of surrender of the petitioners in the court below. Considering the submission of the learned counsel for the petitioners, the period of surrender of the petitioners in connection with the aforesaid case in the court below is further extended for four weeks from today and this applications is, accordingly, allowed with the aforesaid modification in the order dated 14.10.2015 passed in Criminal Misc.
