Petitioners being father, mother and unmarried sister of the victim girl, who is said to have disappeared from the house of her husband, are apprehending their arrest in connection with Siwan (Muffassil) P.S. Case No. 50 of 2015 registered for the offences punishable under Sections 363, 366, 380, 452, 504 and 506 of the Indian Penal Code.
Earlier case diary of the present case was called for, which has since been received.
Learned counsel for the petitioner submits that entire allegation is false and frivolous as the victim girl had gone to live
Patna High Court Cr.Misc. No.23637 of 2015 (3) dt.07-01-2016 with another man out of her own sweet will, with whom, she allegedly established illicit relationship. It is further submitted that it is quite improbable that the father and mother would facilitate such an illegal relationship and encourage the same. Learned counsel for the State submits that there is no cogent material in the case diary so as to implicate the petitioner in the present case.
Considering the aforesaid submissions, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in connection with Siwan (Muffassil) P.S. Case No. 50 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
