JUSTICE SANJAY PRIYA ORAL ORDER 17-09-2018 This application under Section 482 of the Code of Criminal Procedure has been filed for quashing the order dated 30.03.2006 passed by learned Chief Judicial Magistrate, Buxar, in Buxar (T) P.S. Case No. 108 of 2005, G.R. No. 799 of 2005/T.R. No. 396 of 2014 by which the learned Magistrate took cognizance against the petitioners and other accused persons for the offences under Sections 498(A), 323, 504 of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act. Heard learned counsel for the petitioner, learned counsel for the opposite party No. 2 and State. Counter affidavit has been filed on behalf of the
Patna High Court Cr.Misc. No.4631 of 2016 (3) dt.17-09-2018 2/2 opposite party No. 2 stating therein that evidence has already been closed on 17.08.2012 and final argument is going on in the trial. In such circumstances, this Court is not inclined to interfere with the impugned order.
The application stands dismissed.
The court below will proceed with the case in accordance with law and will try to dispose of the same expeditiously.
