JUSTICE ARUN KUMAR ORAL ORDER 15-02-2017 Heard learned counsel for the petitioner and the State. Petitioner is in custody in connection with Buxar (T) P.S. Case No. 427 of 2014 registered under sections 399 and 402 of the Indian Penal Code and sections 25(1-B) (A), 26(2) and 35 of the Arms Act.

Prosecution case in brief is that two miscreants were apprehended by the Police and specific allegation against the petitioner is that one loaded country made pistol was recovered from his possession.

It is submitted that the petitioner has been in custody since 08.9.2014, the day he was apprehended. In this case charge was framed on 20.12.2014 and still two witnesses are yet to be examined and the trial has not concluded.

Patna High Court Cr.Misc. No.6595 of 2017 (2) dt.15-02-2017 Considering the said facts and circumstances, the petitioner, namely, Arman Ansari is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI, Buxar in connection with Buxar(T) P.S. Case No. 427 of 2014 subject to the conditions that one of the bailor must be his family member and he shall be present before the trial court on each date and in case of failure of his appearance on two consecutive date, his bail bond shall liable to be cancelled.
