2. This is the 2nd attempt of the petitioner. The petitioner seeks regular bail in the present case registered for the offence under Sections 8/20(B)/(II)(B)/23(B)/29 of the NDPS Act.
3. As per the prosecution case, 13.5 Kg of Ganja has been recovered from the possession of the petitioner.
4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 02.05.2023. He further submits that out of eight charge-sheeted witnesses, two witnesses have been examined.
5. Learned A.P.P. has vehemently opposed the prayer
Patna High Court CR. MISC. No.58032 of 2024(3) dt.04-02-2025 2/2 for bail.
6. Considering the period of custody, this application for regular bail is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge, Bettiah, West Champaran/concerned Court below in connection with Inarwa P.S. Case No. 43 of 2023 subjects to condition that:- (i). The petitioner will mark his attendance at the Inarwa Police Station, West Champaran on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
(ii). Bailor should be from India and not from Nepal. The Court below will verify the bailors before releasing the petitioner on regular bail.
