JUSTICE PURNENDU SINGH ORAL ORDER 02-05-2023 Heard Mr. Satya Veer, learned counsel appearing on behalf of the petitioner and Mr. Syed Mojibur Rahman, learned APP appearing on behalf of the State.

2. The petitioner apprehends his arrest in connection with Bodh Gaya P.S. Case No. 18 of 2021 registered under Sections 409, 420 and 34 of the Indian Penal Code.

3. Learned counsel appearing on behalf of the petitioner submits that in want of work satisfaction certificate which was required to be issued by the Block Development Officer, Ward No. 6 which shows that the work has been completed by the petitioner and if at all any misappropriation of huge amount of Rs. 13,78,994/- is concerned the same cannot be done by the petitioner who is Secretary of the Dhanwan Panchayat, Ward No. 6. The decision is taken by the Aam Sabha. The cheque is issued in joint signature of Chairman and

Patna High Court CR. MISC. No.54919 of 2022(3) dt.02-05-2023 2/2 and Secretary of the Ward Implementation Committee. Only then the work satisfaction order is issued by the concerned Block Development Officer.

4. Considering the aforesaid fact the petitioner seeks to withdraw the present bail application with a liberty to file a regular bail application bringing on record all the evidences in his favour within a period of 4 weeks till then no coercive steps shall be taken against the petitioner.

5. The Court below is directed to adjudicate the regular bail of the petitioner the same day it is presented before the Court and pass an order without being prejudiced by any earlier order passed by any Court.
