2. The petitioners apprehend their arrest in connection with Bhagwanpur P.S. Case No. 200 of 2025, instituted under Section 30(a) of the Bihar Prohibition & Excise Act.

3. There is recovery of 3.240 litre foreign liquor from a bag which was kept on a motorcycle in the mango orchard.

4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case on the disclosure statement of apprehended co-accused Bablu Chaudhary. Petitioners were not present on the spot and nothing has been recovered from their possession. Petitioners

Patna High Court CR. MISC. No.54659 of 2025(2) dt.19-08-2025 2/2 have no concern either with the recovered liquor or with the said motorcycle or mango orchard. Except the disclosure statement, there is no material against the petitioners. Petitioners have two criminal antecedents in which they are on bail. Petitioners undertake to co-operate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

6. Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge-I, Begusarai in connection with Bhagwanpur P.S. Case No. 200 of 2025, subject to the conditions laid down in Section 482 (2) of the Bharatiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023.
