2. The petitioner seeks bail in connection with Rajapakar P.S. Case No. 267 of 2024 instituted for the offences under Section 303(2) of the Bhartiya Nyaya Sanhita, 2023.
3. As per prosecution case, unknown thief has stolen the motorcycle of the Informant which was in the name of Informant's son Sonu Kumar.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case merely because of his criminal antecedents. He further submits that nothing incriminating has been recovered from the conscious possession of the petitioner. No T.I. Parade has been
Patna High Court CR. MISC. No.54813 of 2025(2) dt.18-08-2025 2/2 conducted by the prosecution. Charge-sheet has been submitted in this case. He further submits that the name of the petitioner has surfaced in this case on the basis of the disclosures made by the Mahal Chowkidar U.P. Paswan. The police has recovered the alleged motorcycle from the Mango orchard. The petitioner has no concern with the alleged occurrence. The petitioner has six criminal antecedents and is languishing in judicial custody since 12.12.2024 without any rhymes or reason.
5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

Having heard rival contention of both the parties and considering the entire facts and circumstances of the case as also taking into account the period of custody of the petitioner, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Rajapakar P.S. Case No. 267 of 2024.
