12-02-2018 Heard Mr. Md. Najmul Hodda, learned counsel for the petitioners and learned Addl. Public Prosecutor. Two petitioners, apprehending their arrest in Suiya P.S. Case No. 113 of 2017 registered for offence under Sections 379/411 of the Indian Penal Code, Sections 21(1), 21(4A) of M.M.D.R. Act, 1957 and Sections 75 & 102(2) of B.M.M.R.- 2017, have prayed for grant of bail in the event of their arrest or surrender.

It was submitted by learned counsel for petitioners that on false accusation of carrying sand on allegation of illegal mining, petitioners have been made accused.

Besides hearing, I have perused the material on record

Patna High Court Cr.Misc. No.6986 of 2018(2) dt.12-02-2018 2/2 and after going through the same, I am of the opinion that it is a fit case for extending the privilege of anticipatory bail. Accordingly, in the event of arrest or surrender within a period of six weeks from today, let both aforesaid petitioners namely Bhawesh Yadav @ Bhawesh Kumar @ Bhawesh Kumar Yadav and Kamal Yadav be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Banka in connection with Suiya P.S. Case No. 113 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
