2. The accused/petitioner apprehending his arrest in connection with Sherghati P.S. Case No. 63 of 2025 registered for the offences punishable under Sections 126(2), 115(2), 64, 62, 329(4) of the Indian Penal Code.

3. As per FIR, petitioner made an attempt to commit rape/penetrative sexual assault upon the informant, aged about 18 years after criminal trespass on intervening night of 24.01.2025.

4. It is submitted by learned counsel appearing for the petitioner that in fact informant and her family members assaulted petitioner out of neighbourhood disputes and

Patna High Court CR. MISC. No.56123 of 2025(3) dt.12-11-2025 2/3 differences on 24.01.2025, for which petitioner lodged a case on 05.02.2025 which was registered as Sherghati P.S. Case No. 54/2025. The aforesaid case also registered for the offence punishable under SC/ST Act, as petitioner is the member of scheduled caste community. It is pointed out that to counter aforesaid case, the present FIR was lodged on 10.02.2025 showing the date of occurrence on 24.01.2025. Petitioner claimed clean antecedent.

5. Learned APP opposed the prayer of bail.

In view of aforesaid factual submissions and by taking note of fact as prima facie the present case appears lodged in the background of enmities arising out of lodging criminal case by the petitioner prior to this FIR, accordingly, above named petitioner, in the event of his arrest or surrender before the learned trial Court, within a period of four weeks of the order, is directed to be released on bail furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1, Sherghati, District- Gaya/concerned Court, where the case is pending in connection with Sherghati
