This application has been filed in connection with Charpokhari P.S. Case No.198 of 2015 for the offence under Sections 3⁄4 Explosive Act and 10, 13, 16, 17 U.A.P. Act and 17 of C.L.A. Act.
It is submitted on behalf of the petitioner that except confessional statement of co-accused before the police, in which his name transpires, there is nothing against him and he is in custody for about 1 1⁄2 months. So far criminal antecedent of the petitioner is concerned, it is submitted that he was accused in five other cases also on the basis of suspicion only and he is on bail. Heard learned A.P.P. also, who could not controvert the above facts.

No.13640 of 2017 (3) dt.04-04-2017 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Bhojpur, Ara in connection with Charpokhari P.S.Case No.198 of 2015.
With following conditions :
(i) One of the bailors of the petitioner shall be a close relative having sufficient immovable property within the jurisdiction of the concerned court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall co-operate in the disposal of trial and make himself available before the court concerned on each and every date and in the event of his failure to appear on two consecutive dates without any sufficient reason will amount to automatically cancellation of his bail bond. With the aforesaid observation, this application is allowed. (Vinod Kumar Sinha, J) chn/- U
