JUSTICE BIRENDRA KUMAR ORAL ORDER 25-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offence punishable under Section 366A of the Indian Penal Code. The F.I.R. was lodged on missing of Puja Kumari, the daughter of the informant, against unknown. The victim girl in her statement under Section 164 Cr.P.C. stated that the petitioner had forcefully took her and attempted to marry with her in Hilsa Court by creating forge documents. Thereafter she was in confinement of sixty days.
Submission of the petitioner is that the matter appears to be of love-affairs and under pressure of the parents statement under Section 164 Cr.P.C. was recorded after two
Patna High Court Cr.Misc. No.18479 of 2017 (2) dt.25-04-2017 2/2 months of the occurrence.
Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-X, Gaya/Successor Court, in connection with Neemchak Bathani P.S. Case No.116 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
