The petitioner seeks bail in a case registered for the offences punishable under Sections 364, 302, 120(B), 201/ 34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 02.06.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

The learned counsel for the petitioner further submits that the informant alleges that this petitioner along with other co-accused came at the house of the informant and took her husband on motorcycle, but the husband of the informant did not return. Thereafter, during search, on 19.07.2020 at around

Patna High Court CR. MISC. No.64580 of 2021(2) dt.31-03-2022 2/2 3.00 P.M., the dead body of the husband of the informant was found floating in the water.

The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. Informant is not an eye witness to the occurrence and the entire allegation hinges only on suspicion and similarly situated coaccused Lala Rai @ Lalu Rai @ Umesh Rai has been granted bail by order dated 07.10.2021 in Cr. Misc. No.40017 of 2021. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent, charge-sheet has been submitted in this case and co-accused has been granted bail, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Panapur P. S. Case No.107 of 2020. The application stands allowed.
