The Petitioner seeks bail in Islampur P.S. Case No. 347 of 2015 instituted for the offence under Section(s) 498-A, 341, 323, 307, 504/34 Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
It has been submitted on behalf of the petitioner that no offence under Section 498-A Indian Penal Code is made out in this case. There is allegation by the informant, who is father of the victim girl, that the accused persons assaulted his wife. It has further been submitted that the daughter of the informant has performed another marriage with Indal Paswan on 11.11.2016. In support of such submission, he has filed certificate granted by the
Patna High Court Cr.Misc. No.5645 of 2017 (2) dt.02-03-2017 2/2 Sarpanch, which is annexed as Annexure-2.
From the written report itself it appears that there is general and omnibus allegation against the petitioner that he assaulted the wife of the informant. The petitioner is in custody since 05.08.2016.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Hilsa, Nalanda, in connection with Islampur P.S. Case No.347 of 2015, subject to the conditions that both the bailors shall be the close relative of the petitioner.
