Petitioner is in custody since 25.09.2016 in connection with Thakurganj P.S. Case No. 94 of 2016 registered under Sections 25(1-b)A, 26 and 35 of the Arms Act.

Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is quite innocent and has falsely been implicated in this case. In fact, no recovery has been made from the conscious possession of the petitioner. Even the petitioner has not been named in the F.I.R and alleged recovery has been made from one co-accused, namely, Sabbir Alam. The petitioner is in custody for the last five months.

Considering the nature of accusation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc.
