The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 498(A)/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
It appears that the petitioner had taken steps to bring back the girl to him and resume a normal marital life but the opposite party No. 2 does not wish to live with her husband and today also, there is no representation on her part or through her counsel before this Court.
Considering the nature of allegations against the petitioner
Patna High Court Cr.Misc. No.3420 of 2015 (7) dt.29-01-2016 P2/2 and that the opposite party No. 2 has also stated on 27.02.2010 (Annexure-2) that she is not willing to live with her husband as her marriage was solemnized against her will, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Begusarai in connection with Mahila P.S. Case No. 42 of 2013 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
