The petitioners seek bail in a case instituted under Section 386 of the Indian Penal Code.
The prosecution story, in brief, is that a ransom of Rs. Ten lac was demanded from unknown mobile numbers, failing which, he along with one Abhishek would be done to death. The mobile numbers from which, ransom was demanded is said to have been registered in the name of the petitioners. It has been submitted on behalf of the petitioners that the petitioners are in custody since 21.12.2016. The charge sheet has been submitted in the present case. The petitioners have got no
Patna High Court Cr.Misc. No.9413 of 2017 (2) dt.16-03-2017 2/2 criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have been made accused due to mistake of fact. As per the allegations, it is at best a case for an offence under Section 385 of the Indian Penal Code, which is bailable.
On behalf of the state, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Purnea, in connection with K. Hat (Sahayak) P.S. Case No. 591 of 2016.
