The petitioner is accused in connection with Dumra P.S. Case No. 323 of 2016, registered under Sections 414/34 of the Indian Penal Code and 136 of the Electricity Act. The accusation is that on receiving secret information about carrying of electric pole loading on a trailer by help of Crain in the supervision of person boarded in Wagon-R, the police started checking of vehicles near village Muhatti and intercepted the trailer, Crain and Wagon-R. On query, no paper was produced about carrying of electric pole. The drivers of Crain, trailer and Wagon-R were apprehended, who disclosed their name Satya Prakash (Petitioner), Dudh nath Rai and Tarun Kumar and they

Patna High Court Cr.Misc. No.9728 of 2017 (2) dt.16-03-2017 did not give satisfactory reply of carrying the electric poles. . Learned counsel for the petitioner submits that, in fact, petitioner is the driver of Crain and he has been apprehended by the police mere on suspicion in the present case and also remanded in three other cases as detailed in paragraph 3 of the case diary. Further submission is that petitioner is in custody since 13.12.2016.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Dumra P.S. Case No. 323 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
