1. Heard the parties.

2. The petitioner has renewed her prayer for regular bail in connection with Tekari P.S. Case No. 386 of 2019 dated 28.10.2019 registered for the offence punishable under section 304(B), 201 & 120(B) of the I.P.C. Earlier, prayer for regular bail of the petitioner was dismissed as withdrawn on 19.03.2025 vide Cr. Misc. No. 17549 of 2025 granting liberty to the petitioner to renew her prayer for regular bail after completion of six months.

3. It is a case of dowry death. The petitioner is the motherin- law of the deceased.

4. Learned counsel for the petitioner submits that charge has been framed on 16.10.2025 but no prosecution witness has been examined as yet. The petitioner is in custody since 21.01.2025.

This court has called for a report regarding the stage of trial vide order dated 22.08.2025 and in pursuance thereof learned District & Additional Sessions Judge- IX, Gaya has submitted his report vide letter no. 239 / 2025 dated 17.10.2025 stating therein that there are altogether ten charge sheet witnesses and charge has been framed on 16.10.2025 and thereafter the case was fixed for evidence and summons were issued upon the witnesses, but no charge sheet witness has been produced by the prosecution as yet.

6. Regard being had to the submissions made by the parties, taking into consideration the fact that this is second attempt for bail on behalf of the petitioner, who is in custody since 21.01.2025, accordingly, I am inclined to grant regular bail to the petitioner.

7. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, VI, Gaya in connection with Tekari P.S. Case No. 386 of 2019.
