JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-04-2017 The petitioner seeks regular bail in connection with Naya Ram Nagar P.S. Case No. 110 of 2016, registered for offences punishable under Section 25(I)a/25 (I-AA)25(I-AC)/25(IB)a/25(I-B)C/26(I)(II)/35 of Arms Act. Allegation is that police on secret information reached at Barahil and surrounded the place and found a mini gun factory was being run and on chase police apprehended this petitioner along with nine others and from possession of the petitioner one country made pistol was recovered.

It has been submitted on behalf of the petitioner that tough there is recovery of one country made pistol from the possession of the petitioner, however, he has sufficiently been punished for the said offence as he has been in judicial custody

Patna High Court Cr.Misc. No.9564 of 2017 (3) dt.21-04-2017 2/3 since 04.08.2016 and other co-accused having similar allegation has already been enlarged on regular bail by this Court vide orders dated 06.02.2017 and 11.01.2017 passed in Criminal Miscellaneous Nos. 2274 of 2017 and 613 of 2017, respectively. Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, nature of allegation, period of custody and also other co-accused persons having similar allegations, have already been enlarged on bail, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Munger, in connection with Naya Ram Nagar P.S. Case No. 110 of 2016, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and
